上一级公安机关交通管理部门收到当事人书面复核申请后5日内，应当作出是否受理决定。

关于行政处罚

但是在一般情况下，当违法行为确定时，交管部门会在交通事故认定之日起5日内，对当事人的违法行为作出行政处罚结论。

在此期间，当事人可以递交《暂缓执行行政处罚申请书》。
